Overview

An appeal is a different kind of proceeding from a trial or administrative hearing. It turns on the written record, the governing law, and the quality of the briefing and argument — not on new evidence. Success on appeal requires identifying the issues that matter, framing them persuasively, and presenting them clearly to the court. Mr. Math has briefed and argued appeals in both state and federal appellate courts for over three decades, and has been admitted to practice before the United States Court of Appeals for the Ninth Circuit since September 29, 1992.

Notable Matters

In Mundy v. United States, 983 F.2d 950 (9th Cir. 1993), the Ninth Circuit reversed a district court’s dismissal, agreeing with our argument that the claim fell within the government’s waiver of immunity under the Federal Tort Claims Act; the client was then able to settle on acceptable terms.

In Hample v. Civil Service Commission of Santa Barbara County (Cal. Ct. App. 2022), a public-employment matter proceeded through two appeals before the California Court of Appeal on the way to a substantial settlement for the client.
